MEADOW OAKS HOMEOWNERS ASSOCIATION
AMENDED DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR MEADOW OAKS ADDITION
This document extracts the pertinent information for the Meadow Oaks Homeowners Association covenants as filed with the the Office of the Register of Deeds of Sedgwick County, Kansas. Official copies can be requested from the Office of the Register of Deeds of Sedgwick County, Kansas.
Article I. Definitions
The following terms used in these covenants, conditions and restrictions shall be applicable to this Declaration and are defined as follows:
1.01 “Association” shall mean and refer to Meadow Oaks Homeowners’ Association, a nonprofit corporation under the laws of the State of Kansas, its successors and assigns.
1.02 “Annual Meeting” shall mean a meeting to be held at a location to be determined by the Board at a date and time to be set during the month of September, beginning no later than September 2010, for the purpose of electing directors and transacting any other business authorized by the Board or by the Members.
1.03 “Board” shall mean and refer to the Board of Directors of the Association.
1.04 “Common Area” shall mean those portions of the Property to be owned by the Association for the common use and enjoyment of the members of the Association. The Common Area to be conveyed to and owned by the Association is described as follows:
Reserves A, B, C and D to Meadow Oaks Addition to Wichita, Sedgwick County, Kansas.
1.04. “Lot” shall mean and refer to each Lot within the Property upon which there may be constructed a single-family residence. It shall not mean or include any part of the Common Area.
1.05 “Member” shall mean and refer to every person or entity that holds membership in the Association.
1.06 “Owner” shall mean and refer to the record owner, whether one or more persons or entities, of a fee simple title to any Lot which is a part of the Property, including contract sellers, but excluding those having such interest merely as security for the performance of an obligation.
1.07 “Property” shall mean and refer to all the property described generally as:
Meadow Oaks Addition to Wichita, Sedgwick County, Kansas.
1.08 “Structure” shall mean and refer to any thing or devise (other than trees, shrubbery, hedges and landscaping), the placement of which upon any Lot may affect the appearance of such Lot, including, by way of illustration and not limitation, any building, garage, porch, shed, greenhouse or bathhouse, covered or uncovered patio, swimming pool, tennis court, clothesline, radio or television antenna, fence, curbing, paving, wall more than two (2) feet in height, signboard or any temporary or permanent improvement to such Lot. “Structure” shall also mean (i) an excavation, fill, ditch, diversion dam or other thing or devise which affects or alters that natural flow of surface water from, upon or across any Lot, or which affects or alters the flow of any waters in any natural or artificial stream, wash or drainage channel from, upon or across any Lot, and (ii) any change in the grade of any Lot of more than six (6) inches from that existing at the time of purchase by each Owner.
